These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions under which users (hereinafter referred to as "Users") may use the chat service (hereinafter referred to as "this Service") provided by the Kazusa DNA Research Institute (hereinafter referred to as "KDRI"). Users agree to these Terms before using this Service.
Article 1 (Content of this Service)
This Service utilizes the AI service "Claude3" provided by Anthropic, PBC (hereinafter referred to as "Anthropic"). Users must understand the following points and use this Service at their own responsibility and discretion:

Users must comply with Anthropic's terms of use.

Claude3 is a generative AI. While response accuracy improves through RAG, due to the nature of generative AI-based chatbots, responses may be creative and differ from the correct answer. Users should verify the accuracy of responses themselves.

This Service is not configured to provide appropriate advice in specific professional fields (including but not limited to medical, financial, and legal fields). Users should consult experts to verify the accuracy of chatbot responses, particularly regarding information related to life, health, or property.

Users must not input personal or confidential information when using this Service.
Article 2 (User Warranties)

Users warrant to KDRI that they have the legitimate authority to input the data used for this Service (hereinafter referred to as "User Data," including input information and data sources) and that providing such data does not violate any laws or regulations.

KDRI shall not be liable for any deficiencies or inaccuracies in User Data, including any resulting contractual nonconformity in the provision of this Service.

KDRI is not responsible for verifying the accuracy, completeness, validity, usefulness, or security of User Data.
Article 3 (User Data)

KDRI acknowledges that the rights to User Data belong to the Users and that providing such data does not transfer, assign, or license the intellectual property rights to KDRI.

KDRI may use, reproduce, or modify User Data and usage history for the operation, maintenance, modification, and development of this Service but will not use it for any other purposes.

KDRI may record User Data for backup purposes but is not obligated to store backup data.
Article 4 (Prohibited Actions)
Users must not engage in or facilitate any of the following actions while using this Service:

Inputting confidential or personal information.

Violating laws, court decisions, or legally binding administrative measures.

Engaging in actions that disrupt public order or morality.
-
Infringing upon the rights of KDRI or third parties (including intellectual property, reputation, privacy, and contractual rights).

Impersonating KDRI or third parties, or intentionally spreading false information.

Analyzing or inspecting this Service to obtain its structure, operation, or specifications.

Collecting, disclosing, or providing third-party personal information, registration information, or usage history without permission.

Interfering with the operation of this Service or obstructing its use by other users.

Violating these Terms or the terms set by Anthropic.

Copying, translating, or modifying this Service without authorization.

Selling, distributing, sublicensing, publicly transmitting, lending, transferring, or leasing this Service.

Bypassing technical protection measures (such as copy protection) in this Service.

Reverse assembling, reverse compiling, or reverse engineering this Service.

Conducting any actions similar to the above.

Any other actions deemed inappropriate by KDRI.
Article 5 (No Warranty)
This Service is provided "as is," and KDRI makes no express or implied warranties, including but not limited to:

Fitness for a particular purpose.

Expected functionality, commercial value, accuracy, or usefulness.

Compliance with laws or industry regulations applicable to Users.

Uninterrupted or error-free operation.
-
Proper quality or the absence of harmful content.

Prevention of data loss or damage.
Article 6 (Service Suspension and Modifications)

KDRI may suspend or discontinue all or part of this Service without prior notice in the following cases:

Regular or emergency system maintenance.

Accidental failures of computers or communication lines.
-
Unavoidable circumstances such as fire, power outages, or natural disasters.

Suspension or discontinuation of Claude3.
-
Suspension or discontinuation of necessary external systems.
-
Other technical or operational reasons that make continued operation unfeasible.

In cases of planned maintenance, KDRI will notify Users in advance. In emergency cases, KDRI will make efforts to notify Users afterward and restore the service as soon as possible.

KDRI may modify or terminate this Service at its discretion.

KDRI is not liable for any damages incurred by Users due to actions taken under this Article.
Article 7 (User Responsibility for Equipment)

Users are responsible for preparing and maintaining the necessary equipment, software, communication lines, and network environment at their own expense.

Users must implement appropriate security measures at their own expense to prevent virus infections, unauthorized access, and information leaks.

Users are responsible for backing up any data they provide or receive through this Service. KDRI is not responsible for data storage, preservation, or backup.
Article 8 (Disclaimer and Limitation of Liability)

KDRI is not liable for any damages incurred by Users in connection with this Service, except in cases of intentional misconduct or gross negligence. However, if this contract qualifies as a consumer contract under applicable laws, this clause does not apply.

In cases where KDRI is liable for damages, compensation shall be limited to actual, direct damages incurred, and KDRI shall not be liable for lost profits. However, if this contract qualifies as a consumer contract and the damages result from the intentional misconduct or gross negligence of KDRI, its representatives, or employees, this clause does not apply.
Article 9 (Changes to These Terms)
KDRI may revise these Terms as necessary in accordance with applicable laws. When making changes, KDRI will implement appropriate procedures based on the nature of the changes. Users will be deemed to have agreed to the revised Terms once they are appropriately notified of the changes and the changes take effect.
Article 10 (Governing Law and Jurisdiction)
These Terms are governed by Japanese law. Any disputes arising from or related to this Service between Users and KDRI shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
